Proposed Regulation Changes Affecting Faculty

The Constitution Committee has reviewed the proposed regulation changes that will be noticed for March public hearings and makes the following recommendations. The Committee has adopted a color-coded key for easily identifying the regulation changes that it feels need further consideration.

Red – These regulation changes have elements that many faculty members might disapprove or deem to be controversial and, therefore, should be given thoughtful consideration by all.

Yellow – These regulation changes have elements that concern a limited group of faculty and we recommend that those faculty examine the rule changes closely and express their views both to the Senate and to the administration through the public hearings if they feel it is appropriate.

Green – These regulation changes had some impact on faculty but generally made only stylistic or technical changes.

Caveat: while the Constitution Committee has attempted to review every regulation in light of its

potential impact on faculty, we are only a small group with limited knowledge of the specific workings of every aspect of the University. Our recommendations should not substitute for individual examination of each regulation change.

GREEN- These regulations seem acceptable

3.0022 Bill Paying, Returned Check and Electronic Transfer Items Service Charges- the regulation is being changed to clarify that the University Cashier in Criser Hall no longer accepts payments in cash and that the University reserves the right to refuse to accept foreign checks. The Regulation clarifies that a returned check will cause a hold to be placed on a student's account which prevents the student from receiving grades/transcripts and/or diploma and that the student will not be permitted to register in future semesters until the account has been satisfied. The regulation adds a provision allowing each department to determine how it will accept payment for a returned check. Finally, the Regulation contains a provision for the return of ACH (electronic transfer) payments and the fees to be imposed for processing ACH returns.

3.002 University Financial Services- The Regulation clarifies that a returned check will cause a hold to be placed on a student's account which prevents the student form receiving grades/transcripts and/or diploma and that the student will not be permitted to register in future semesters until the account has been satisfied. Technical changes have also been made to this regulation.

2.018 No Smoking-The regulation is being repealed effective July 1, 2010. The subject matter will be covered in UF 2.022.

RED- There Regulations may require full Faculty Senate discussion and consideration.

2.022 No Smoking and Tobacco Use- This regulation, effective July 1, 2010, prohibits smoking as well as the use of smokeless tobacco and electronic devices intended to simulate smoking on the University of Florida campus. the University of Florida campus includes all lands occupied or controlled by the University located in Alachua County and the City of Jacksonville as well as lands occupied or controlled by fraternities and sororities recognized by the University and any lands in the State of Florida on which there is a health care facilities occupied or controlled by the University.

2.003 Distribution of Printed Material- The changes to Regulation UF 2.003 explain the University's goals with regard to the distribution of printed materials on campus, which are to encourage civil discourse in accordance with First Amendment protection and to reduce litter and landfill waste streams in furtherance of the University's health and environmental mission. The changes clarify to locations and condition sunder which printed materials may be distributed on campus. The revised regulation sets forth the manner in which printed materials may be distributed, including manned distribution as well as provisions for unmanned distribution and the use of modular units and non-modular units. Details are provided regarding the use and locations of modular units on campus, including requirements and procedures for approval, rental fees, and conditions for continued use. In addition, the revised physical characteristics of such units, placement locations and removal requirements. The regulation adds the provision that any member of the University community who wrongfully intervenes with the distribution of printed materials is subject to disciplinary action by the University.
